Below are Jardy’s Terms of Service. They apply to all Jardy users. “We,” “our” or “us” refers to Jardy Inc. “ Jardy” refers to the software platform and services offered by Jardy Inc. By choosing to use Jardy, you are agreeing to our Terms of Service, Privacy Policy, and any other policies we post. Please review them carefully and let us know if you have any questions. For questions regarding our data and privacy practices, take a look at out Privacy Policy. In accordance with our Privacy Policy, we can collect and use your information. When you create an account you must provide us with accurate information, in good faith, and you agree to keep your information updated if it changes. To sign up, you must be 18 years or older or have your parent’s permission. You are responsible for anything that occurs when someone is signed in to your account, as well as the security of your account. Please contact us at support@ Jardy.com immediately if you believe your account has been compromised.Summary: Act responsibly and don’t violate our policies.
You are responsible for all activity on your account. If you violate our policies we have the right to terminate your account. Don’t do anything illegal, that attempts to abuse or circumvent the intended use of our platform, that misuses our platform, or negatively impacts Jardy in any way. While this generally covers issues that could arise, anything that you do to hurt Jardy, our platform, or our users that is not listed will result in us taking action to prevent it.Summary: A user is anyone who creates an account on Jardy. There are multiple subscription tiers, some of which are paid and others that are free.
To become a user, simply follow our onboarding guidelines to create your account. After creating an account, you become a Jardy user. To become a paying user on Jardy, add your preferred payment method and upgrade your subscription.Summary: Fees will be incurred based on your account type, and the subscription you purchase on Jardy.
There are subscription fees associated with maintaining a Jardy account, depending on the subscription tier you have selected.,There are subscription fees to use the Jardy platform (depending on the size of your team and usage), add new seats to your Jardy account, and upgrade your account to a tier which includes increased functionality. These are monthly subscriptions which are paid by month, or annual subscriptions where you pay for a year up front. ,The timing and amount of each subscription depends on the tier you select. You can see the details of what is offered within each subscription tier at the time of selection. You can view your current subscription, as well as a history of past charges incurred, within your account.Summary: You may cancel your subscription at any time. You are responsible for downgrading your Jardy subscription and / or cancelling your account if you no longer would like to incur charges. You are responsible for the loss of access to your subscription, service, and / or account after you cancel.
You may cancel your subscription payments at any time. Terminating or lowering the subscription tier will go into effect in the subsequent (not current) payment term. Increasing your subscription to a higher tier level will go into effect in the current payment term. If you no longer wish to incur fees or charges, it is your sole responsibility to cancel your subscription and / or services. You are responsible for the resulting loss of access to your subscription, service, and / or account.Summary: We do not issue refunds.
Our policy is no refunds. However, we do allow for some exceptions where refunds are granted at our sole discretion.Summary: Do not share your account information with another person. You cannot use our platform to create a competitor.
We do not allow users to share their account information with another person, and doing so is a violation of our policies. It is also a violation of our policies to use our platform to create, or attempt to create, a competitor of any kind, be it a competitive platform or offering competing service.Summary: You can delete your account by emailing our support team. We can disable your account at our discretion.
You can permanently delete your account at any time by emailing us at support@ Jardy.com and requesting account deletion. We can suspend or terminate your account at any time at our discretion. We can also cancel any subscription or service at our discretion. You may not bring a claim against us for suspending or terminating your or another person’s account, and you agree you will not bring such a claim. If you try to bring such a claim, you are responsible for the damages caused, including attorney fees and costs. These terms remain in effect even if you no longer have an account.Summary: You are responsible for the information you input into Jardy.
You are able to, and at times asked to, input various details about your business or organization, employees, associated parties, and / or self on Jardy. It is your responsibility to input these details accurately to the best of your abilities and knowledge, and you agree to keep the information updated if it changes. Further, it is up to you to keep these details secure. With your permission, we may give other websites or services the ability to verify information about your Jardy account or perform actions on your behalf. This permission is asked for when you connect your Jardy account to these other websites or services. You can learn more in our Privacy Policy.Summary: You may grant Jardy permission to access third-party apps. You may also revoke that permission.
You may grant Jardy access to your third-party accounts, such as Google, in order for some Jardy features to operate. When you connect your third-party account, that third-party account will present a page that describes the information that Jardy can access. At any time, you can revoke our access to those accounts using the respective third party’s security settings page.Summary: If you have a problem please talk to us. Any disputes with us must be resolved in Los Angeles under California law.
We encourage you to contact us if you have an issue. If a dispute does arise out of these terms or in relation to your use of Jardy, then the dispute shall be resolved in the federal or state courts located in Los Angeles, California. Both parties consent to the exclusive jurisdiction and venue of the Los Angeles courts for the purpose of resolving any such dispute. California law, excluding its conflict of law provisions, governs these terms, all other Jardy policies, and any dispute that arises between you and us.Summary: We do our best to make sure Jardy works as expected, but that is not always the case.
Jardy IS PROVIDED “AS IS” AND WITHOUT WARRANTY OF ANY KIND. ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY OTHER WARRANTY IS EXCLUDED TO THE GREATEST EXTENT PERMITTED BY LAW. THE DISCLAIMERS OF WARRANTY UNDER THIS CLAUSE ALSO APPLY TO ANY SERVICES WE, OR A THIRD PARTY SERVICE PROVIDER, OFFER ON Jardy.Summary: If we are sued because of your use on Jardy, you have to help pay for it.
You will indemnify us from all losses and liabilities, including legal fees, that arise from your breach of these terms or relate to your use of Jardy. We reserve the right to exclusive control over the defense of a claim covered by this clause. If we use this right then you will help us in our defense. Your obligation to indemnify under this clause also applies to our subsidiaries, affiliates, officers, directors, employees, agents and third party service providers.Summary: These terms are the final word on Jardy’s policies. By continuing to use Jardy, you agree to our policies.
These terms and any referenced policies are the entire agreement between you and us, and supersede all prior agreements. If any provision of these terms is held to be unenforceable, then that provision is modified to the extent necessary to enforce it. If a provision cannot be modified, it is severed from these terms, and all other provisions remain in force. If either party fails to enforce a right provided by these terms, it does not waive the ability to enforce any rights in the future. We may sometimes make changes to these terms and policies. If we make material changes, we will let you know before the changes come into effect. Continuing to use Jardy after a change means you accept the new terms or policies. These terms are an agreement with Jardy, 2315 Locust St, St Louis, MO 63103. Effective immediately for Jardy users from January 1, 2022 onwards.
